Nyanza: Father and son who are being accused the crime of defilement of young girls have appealed to court’s decision to be held in jail for thirty (30) provisional days.
The father and his son who are being accused the crime defilement of young girls were not happy with the decision of Busasamana court in Nyanza, where the court decided to them to be followed while in jail for thirty (30) provisional dayan old man identified as Claver of 66 years-old ,and his son ,Tuyishime of 25 years-old are the ones to be accused have defiled the young girls , one of 17 years-old and other of 16 years-old.
The accused were not satisfied with the decision to place them in provisional detention and immediately appealed it to the Intermediate Court of Huye.
Reliable sources say that one of the reasons for their appeal is the possibility that medical reports may have been issued which could help them, as they are believed to show that the girls were not defiled.
Both suspects are currently held at Huye prison.
It is alleged that the crime for which Claver and his son are being prosecuted took place in Gakenyeri village, Nyanza cell, Busasamana sector, Nyanza district.
According to the prosecution, the girls went to Claver asking for a job selling doughnuts. Claver, who owned a bar where he lived with his son, gave them work. The girls would sell doughnuts during the day in different places and then return to stay in a house Claver had given them, where it is alleged Claver and his son would take turns raping them at night.
The children testified that whenever they refused to have sex with them, they were threatened with a knife and told they would be killed if they resisted.
The children further testified that Claver also prostituted them to other men, being the one who collected the money. When they asked him for their payment, he allegedly lied that he would pay them later.
They claim Claver and his son raped them for six consecutive nights.
However, Claver and his son denied the charges, arguing that the whole story was a fabrication.
Their lawyer, Me Jean Paul Mpayimana, argued that it was impossible for a man who runs a bar, hires children, and allegedly sells them for sex while also raping them, not to have been exposed and denounced immediately.
Me Jean Paul Mpayimana also said it was inconceivable that an old man could rape a child and even take turns with his own son in the same act, all happening at night in the same room.
Me Jean Paul Mpayimana stated: “These horrors never happened. Everything is a conspiracy by those children. Their statements should not be considered credible.”
Unless anything changes, the appeal case against the decision to place them in provisional detention will be heard this month.
